VISA FOR SLOVENIA

To live, work or study in Slovenia, you may require a visa. If you are a citizen of a European Union (EU) member state, free movement of workers applies, and you will not require an additional visa to apply for work in Slovenia. All foreign workers in Slovenia receive the same working rights, fair treatment, and public holidays as local workers.

Za življenje, delo ali študij v Sloveniji boste morda potrebovali vizum. Če ste državljan države članice Evropske unije (EU), velja prosto gibanje delavcev in za prijavo na delo v Sloveniji ne boste potrebovali dodatnega vizuma. Vsi tuji delavci v Sloveniji imajo enake delovne pravice, pošteno obravnavo in proste delovne dneve ob praznikih kot domači delavci.

Visa requirements

You will be required to provide:

  • A completed visa application form.
  • Two passport-sized photos.
  • Passport with at least two blank pages and validity for at least three months beyond the return date.
  • Copy of your return airline or travel tickets.
  • Confirmation of health insurance with a minimum coverage of 30,000 euros.
  • Evidence of financial means to support yourself and any dependants for your length of stay within the country.

Zahteve za izdajo vizuma

Za pridobitev vizuma boste morali predložiti:

  • Izpolnjen obrazec za vlogo za vizum.
  • Dve fotografiji ustrezne velikosti za potni list.
  • Potni list z vsaj dvema praznima stranema in veljavnostjo še najmanj tri mesece po datumu vrnitve.
  • Kopija vaše povratne letalske ali potovalne karte.
  • Potrdilo o zdravstvenem zavarovanju z minimalnim kritjem 30.000 eur.
  • Dokazila o finančnih sredstvih za preživljanje sebe in morebitnih vzdrževanih družinskih članov v času vašega bivanja v državi.

To obtain a work permit in Slovenia, as a non-EU citizen, you can only obtain a work permit through sponsorship by an employer, as the permits are issued upon the request of the employer. It is also important to first check if your profession is regulated in Slovenia (such as medicine, teaching, etc.), as these jobs will require you to submit your qualifications to the Ministry of Labour, Family and Social Affairs for recognition. For the employer to hire a non-EU worker, the conditions include:

  • There must be no suitable candidates for the job currently registered with the Employment Service of Slovenia.
  • The employment must not cause any disturbance within the Slovenian labour field.

If you are planning to work in the country for more than three months, you will need a Residence Permit. You can obtain the Residence Permit by applying to the local Administrative Unit with proof of identity and a valid passport. You will also be required to provide proof of employment from your new employer, and evidence that you have health insurance to cover you during your time in the country.

EU citizens do not require a visa to study in Slovenia. Non-EU citizens may apply for a visa which allows them to study in the country. They must have proof of enrollment from their educational institution and a no-objection certificate from the university or school. Most student visas will be a short-stay visa (Visa C) or a long-stay visa (Visa D).

It is possible to set up a business in Slovenia as an entrepreneur, as long as the business owner registers as an economic subject and meets the requirements for their particular business type. The Slovenian government has set up the e-VEM system to assist those who are thinking of, or are in the process of, starting their own business. New business owners must complete all paperwork and obtain a digital certificate, must have an office space, and must obtain all necessary permits.

Za pridobitev delovnega dovoljenja v Sloveniji lahko kot nedržavljan EU delovno dovoljenje pridobite le preko vašega delodajalca, saj se dovoljenja izdajo na zahtevo delodajalca. Pomembno je tudi, da najprej preverite, ali je vaš poklic v Sloveniji reguliran (npr. medicina, pedagoški poklic itd.), saj boste za ta dela morali svoje kvalifikacije predložiti v priznanje Ministrstvu za delo, družino in socialne zadeve. Za delodajalca, da zaposli delavca, ki ni državljan EU, morajo biti izpolnjeni naslednji pogoji:

  • Za to delovno mesto na Zavodu RS za zaposlovanje trenutno ne sme biti prijavljenih ustreznih kandidatov,
  • Zaposlitev ne sme povzročati motenj na slovenskem delovnem področju.

Če nameravate v državi delati več kot tri mesece, boste potrebovali dovoljenje za prebivanje. Dovoljenje za prebivanje lahko pridobite tako, da vložite vlogo na krajevni upravni enoti z dokazilom o identiteti in veljavnim potnim listom. Prav tako boste morali predložiti dokazilo o zaposlitvi pri vašem novem delodajalcu in dokazilo, da imate zdravstveno zavarovanje, ki vas krije v času vašega bivanja v državi.

Državljani EU za študij v Sloveniji ne potrebujejo vizuma. Nedržavljani EU lahko zaprosijo za vizum, ki jim omogoča študij v državi. Imeti morajo dokazilo o vpisu svoje izobraževalne ustanove in potrdilo o neugovarjanju univerze ali šole. Večina študentskih vizumov bo vizum za kratkoročno bivanje (vizum C) ali vizum za dolgoročno bivanje (vizum D).

V Sloveniji je mogoče ustanoviti podjetje kot podjetnik, če se lastnik podjetja registrira kot gospodarski subjekt in izpolnjuje pogoje za svojo vrsto dejavnosti. Slovenska vlada je vzpostavila sistem e-VEM za pomoč tistim, ki razmišljajo ali so v procesu ustanovitve lastnega podjetja. Novi podjetniki morajo urediti vso dokumentacijo in pridobiti digitalno potrdilo, imeti morajo pisarniški prostor in pridobiti vsa potrebna dovoljenja.

OPENING A BANK ACCOUNT

The major banks in Slovenia are Nova Ljubljana Banka (NLB), SKB Banka, Delavska hranilnica and Nova KBM. NLB is the largest bank in Slovenia so can be a convenient option for expats.

Večje banke v Sloveniji so Nova ljubljanska banka (NLB), SKB banka, Delavska hranilnica in Nova KBM. NLB je največja banka v Sloveniji, zato je lahko priročna izbira za izseljence.

Slovenia has a strong banking industry. National and international banks are located throughout the country, along with a large network of ATM machines in most towns, and withdrawals are available from local or international bank accounts. Major banks are more likely to have English-speaker tellers to assist with opening an account, and some banks have websites in both English and Slovenian.

Slovenija ima močno bančništvo. Nacionalne in mednarodne banke se nahajajo po vsej državi, skupaj z veliko mrežo bankomatov v večini mest, dvigi pa so na voljo z lokalnih ali mednarodnih bančnih računov. Večje banke imajo pogosteje angleško govoreče blagajnike za pomoč pri odpiranju računa, nekatere banke pa imajo spletne strani v angleščini in slovenščini.

Banks can also assist with overseas transfers, although transfer fees will apply. Having a local bank account will avoid withdrawal and transaction fees from your previous bank, making it easier and cheaper to pay bills, use ATMs and make local purchases. Banks can also assist with business and personal loans.

Banke lahko pomagajo tudi pri nakazilih v tujino, vendar bodo zaračunane provizije za prenos. Če imate lokalni bančni račun, se boste izognili provizijam za dvige in transakcije pri prejšnji banki, zaradi česar bo lažje in cenejše plačevanje računov, uporaba bankomatov in opravljanje lokalnih nakupov. Foreign residents can open bank accounts in Slovenia, and the process is simple and straightforward. If you will be working in the country, it is important to have a local account, as many companies will pay salaries via direct deposit into your nominated bank account. A bank account can be opened in a local branch of your bank or can be done online in some circumstances. To open a personal account, you’ll need:

  • Valid passport (EU or non-EU issued)
  • Slovenian tax number
  • Foreign tax number

Before opening a bank account, you may wish to check if your current bank has international branches in Slovenia. There are multiple types of bank accounts available, including savings accounts, joint accounts (an account shared by two or more people) and transaction accounts (for purchases).

Good to know: International students are also able to open a local bank account.

If you have recently opened a company in Slovenia, you will also need to open a business bank account. Any big bank will be able to offer a business account to a new business. After a new company has been registered, it is a requirement to open a business account.

The bank will require:

  • A Slovenian tax number
  • All documentation and paperwork from the company’s registration
  • The work and residence permit card of the company director or operator.

Good to know: There are third party companies which assist with this process if needed, for a fee.

When you open a bank account in Slovenia, you will receive a debit card for withdrawing money and making purchases. The card will be mailed to you shortly after opening an account. Most bank debit cards are the ‘chip and pin’ style ‘ you insert your card into a machine and enter your four or six-digit secret number for the purchase to be authorised by your bank.

You can also often apply for credit cards through your bank, although the approval process may be more difficult for new arrivals without a credit history. Visa, Mastercard and American Express are commonly accepted in most locations, although some small businesses, especially outside of the larger cities, may take only cash.

Tuji rezidenti lahko odprejo bančne račune v Sloveniji, postopek pa je preprost in enostaven. Če boste delali v državi, je pomembno, da imate lokalni račun, saj bo veliko podjetij izplačevalo plače prek neposrednega depozita na vaš imenovani bančni račun. Bančni račun lahko odprete v lokalni podružnici vaše banke ali v nekaterih okoliščinah na spletu. Če želite odpreti osebni račun, potrebujete:

  • Veljaven potni list (izdan v EU ali zunaj EU)
  • slovenska davčna številka
  • Tuja davčna številka

Ko odprete bančni račun v Sloveniji, prejmete debetno kartico za dvig denarja in nakupe. Kartico vam bodo poslali kmalu po odprtju računa. Večina bančnih debetnih kartic je v slogu “chip and pin” – kartico vstavite v napravo in vnesete svojo štiri- ali šestmestno tajno številko, da bo vaša banka odobrila nakup.

Za kreditne kartice lahko pogosto zaprosite tudi prek svoje banke, čeprav je postopek odobritve morda težji za nove prišleke brez kreditne zgodovine. Kartice Visa, Mastercard in American Express običajno sprejemajo na večini lokacij, čeprav lahko nekatera mala podjetja, zlasti zunaj večjih mest, vzamejo samo gotovino.

BUYING A REAL ESTATE IN SLOVENIA

Foreigners can acquire ownership rights to real estate in the Republic of Slovenia under the conditions stipulated by law or an international treaty ratified by the National Assembly.

Tujci lahko pridobivajo lastninsko pravico na nepremičninah v Republiki Sloveniji pod pogoji, ki jih določa zakon ali mednarodna pogodba, ki jo ratificira Državni zbor.

Taking into account laws and international treaties, we can classify foreigners (foreign citizens and legal entities based abroad) into the following groups with regard to the possibility of acquiring ownership rights to real estate in the Republic of Slovenia:

Ob upoštevanju zakonov in mednarodnih pogodb lahko glede možnosti pridobitve lastninske pravice na nepremičninah v Republiki Sloveniji tujce (tuje državljane in pravne osebe s sedežem v tujini) razvrstimo v naslednje skupine:

  1. Foreigners who do not need a decision establishing reciprocity in order to acquire property rights in real estate: citizens and legal entities of EU, OECD and EFTA member states and persons with the status of Slovenian without Slovenian citizenship.
  1. Tujci, ki za pridobitev lastninske pravice na nepremičninah ne potrebujejo odločbe o ugotovitvi vzajemnosti: državljani in pravne osebe držav članic EU, OECD in EFTE ter osebe s statusom Slovenca brez slovenskega državljanstva.

2. Foreigners who need a positive decision establishing reciprocity to acquire property rights: citizens and legal entities of candidate countries for EU membership (Republic of North Macedonia, Republic of Serbia, Montenegro, Republic of Albania, Ukraine, Republic of Moldova).

2. Tujci, ki za pridobitev lastninske pravice na nepremičninah potrebujejo pozitivno odločbo o ugotovitvi vzajemnosti: državljani in pravne osebe držav kandidatk za članstvo v EU (Republika Severna Makedonija, Republika Srbija, Črna gora, Republika Albanija, Ukrajina, Republika Moldavija).

3. Foreigners who cannot acquire ownership rights to real estate or can only acquire it on the basis of inheritance: citizens and legal entities from all other countries that do not fall into any of the groups listed above (including Bosnia and Herzegovina, the People’s Republic of China, Russian Federation).

3. Tujci, ki lastninske pravice na nepremičninah ne morejo pridobiti oziroma jo lahko pridobijo le na podlagi dedovanja: državljani in pravne osebe iz vseh ostalih držav, ki se ne uvrščajo v nobeno od zgoraj naštetih skupin (med drugim tudi Bosna in Hercegovina, Ljudska republika Kitajska, Ruska federacija).

WHERE CAN I BUY A REAL ESTATE IN SLOVENIA?

When acquiring property rights to real estate through inheritance, foreign legal heirs and foreign testamentary heirs, who would be heirs also according to legal inheritance, do not need a decision establishing reciprocity.

In the currently initiated procedures for registration of property rights on real estate, foreigners from the former republics of the SFRY who met all the conditions for registration before 12/31/1990 do not need a decision (however, the registration was not realized or the procedure for registration in the land register was not started).

Pri pridobitvi lastninske pravice na nepremičnini z dedovanjem odločbe o ugotovitvi vzajemnosti ne potrebujejo tuji zakoniti dediči in tuji oporočni dediči, ki bi bili dediči tudi po zakonitem dedovanju.

V sedaj začetih postopkih vknjižbe lastninske pravice na nepremičninah odločbe ne potrebujejo tujci iz bivših republik SFRJ, ki so vse pogoje za vknjižbo izpolnjevali že pred 31. 12. 1990 (vendar pa vpis ni bil realiziran oziroma postopek vpisa v zemljiško knjigo ni bil začet).

Procedure for determining reciprocity

The procedure begins at the request (application) of a foreigner who wants to acquire ownership rights to real estate in the Republic of Slovenia. The foreigner submits the application to the Ministry of Justice. A foreigner who does not live in the Republic of Slovenia is obliged to appoint a representative in the Republic of Slovenia.

The application for establishing reciprocity must be accompanied by:

  • a certified copy of a personal document showing the following information: personal name, date of birth and citizenship of a foreign natural person, or an original or certified copy of a public document showing the company and registered office of a foreign legal entity (e.g. a certified copy of a passport – for natural persons, the original or a certified copy of the extract from the business register – for legal persons),
  • if the foreigner has dual citizenship, also proof of last permanent residence (in the form of a public document in the original or a certified photocopy),
  • if the foreigner does not have the citizenship of any country, also a statement on whether the legal order of the country of his birth or the country in which he has permanent residence, or the country in which the foreigner had his last permanent residence before obtaining a permanent residence permit, should be taken into account when determining reciprocity in the Republic of Slovenia,
  • a document with which the foreigner demonstrates the right to establish reciprocity (e.g. draft or copy of the sales contract).

When submitting an application, an administrative fee of EUR 22.60 must be paid in person or by money order.

On the basis of a complete application, the Ministry ex officio obtains data on the real estate, then checks the data on the legal order of the foreign country and issues a decision with abbreviated reasons within 30 days of receiving the complete application.

Postopek ugotavljanja vzajemnosti

Postopek se začne na zahtevo (vlogo) tujca, ki želi pridobiti lastninsko pravico na nepremičnini v Republiki Sloveniji. Vlogo tujec poda pri Ministrstvu za pravosodje. Tujec, ki ne živi v Republiki Sloveniji, je dolžan imenovati pooblaščenca v Republiki Sloveniji.

Vlogi za ugotovitev vzajemnosti treba priložiti:

  • overjeno kopijo osebnega dokumenta, iz katerega so razvidni naslednji podatki: osebno ime, datum rojstva in državljanstvo tuje fizične osebe oziroma original ali overjeno kopijo javne listine, iz katere so razvidni podatki o firmi in sedežu tuje pravne osebe (npr. overjena kopija potnega lista – za fizične osebe, original ali overjena kopija izpisa iz poslovnega registra – za pravne osebe),
  • če ima tujec dvojno državljanstvo, tudi dokazilo o zadnjem stalnem prebivališču (v obliki javne listine v originalu ali overjeni fotokopiji),
  • če tujec nima državljanstva nobene države, tudi izjavo o tem, ali naj se pri ugotavljanju vzajemnosti upošteva pravni red države njegovega rojstva ali države, v kateri ima stalno prebivališče, ali države, v kateri je imel tujec zadnje stalno prebivališče pred pridobitvijo dovoljenja za stalno prebivanje v Republiki Sloveniji,
  • listino, s katero tujec izkazuje pravico do ugotovitve vzajemnosti (npr. osnutek ali kopija prodajne pogodbe).

Ob vložitvi vloge je treba plačati upravno takso v višini 22,60 EUR osebno ali s položnico.

Na podlagi popolne vloge ministrstvo po uradni dolžnosti pridobi podatke o nepremičnini, nato preveri podatke o pravnem redu tuje države in izda odločbo s skrajšano obrazložitvijo v roku 30 dni od prejema popolne vloge.
